LGA nullifies Dhonfanu council’s diving ban amid ongoing protests
The Local Government Authority (LGA) has issued a statement declaring that the B. Dhonfanu Council’s temporary ban on diving and snorkeling within 700 meters of Dhonfanu’s shoreline is unlawful.
According to the press release, Article 56-3(a) of Law No. 7/2010 stipulates that, except in areas designated for natural or environmental protection, every Maldivian citizen has the right to carry out activities not prohibited by law without additional permission, even in areas under a specific council’s jurisdiction.
The LGA stated that the council exceeded its authority and instructed that the ban be nullified.
The council had implemented the ban earlier today after announcing plans for a series of sea protests by island residents.
The protests were in response to the government’s land reclamation project on Dhonfanu, a small island with a population of around 400.
On August 13, Maldives Transport and Contracting Company (MTCC) was awarded a contract to reclaim 13 hectares of land, a move criticized by environmentalists for its potential impact on Hanifaru Bay, one of the Maldives’ most important marine habitats.
Although President Dr. Mohamed Muizzu later scrapped the project in response to public concern, protests on Dhonfanu have continued.
The council justified its diving and snorkeling ban, citing safety concerns during protest hours.
Following the LGA statement it has been clarified that local councils do not have the authority to restrict activities in areas beyond their legal jurisdiction.
